Back to Basics: How Do I Get Divorced?
“How do I get divorced?” is a questions that we know people will have asked themselves long before they consider asking us.
Whilst google has some information available, and friends and families who have been through the process will have other information, hopefully this will give you a snapshot as to what you need to know.
Getting divorced used to be slightly more complex, and require an element of “blame” or at the very least, the passage of time; 2 or 5 years to be precise. The Divorce, Dissolution and Separation Act 2020 completely reshaped the law, and we now have finally caught up with Scotland and have “no fault divorce”.
As such, for you to get divorced now, you simply need to be able to establish the following:-
- You have been married for at least a year.
- Your marriage is legally valid
- The marriage has irretrievably broken down
You will need your original marriage certificate and the Court fee of £593 (this is set to rise, but not just yet), and of course, courage to close one chapter and start the next chapter of your life.
